Can I get a Conditional License if I am Arrested for a DWI?

Many people come to me after they’re arraigned on a DWI charge and their license was taken by the court. They ask me about the ability to obtain a conditional license. A conditional license is a license that gives you very limited driving privileges. It allows you, for example, to drive to and from work, to and from school, to and from medical appointments, and it generally gives you some limited driving outside of those areas.

Very often people charged with DWI will qualify for a conditional license, but it depends on every individual circumstance. There’s also something called the Hardship License in the state of New York which people need to be aware of. This is another type of license that gives limited driving privileges that may give people the ability to drive to and from work. An experienced criminal defense attorney should be able to answer these questions given your limited circumstances, and if necessary, walk you through a Hardship Hearing before a judge to be able to obtain some limited driving privileges.
