Penalties for Illegal Firearm Possession

In order to legally possess a handgun in the state of New York, you must obtain a handgun license. Those who are found unlawfully in possession of a handgun may face a variety of charges that fall under the category of criminal possession of a weapon.

The following are the penalties for possession of a weapon in NY:

Criminal Possession of a Firearm – Simple possession of a firearm that is either unloaded or is possessed in a person’s home or place of business is a class “E” felony, which is punishable by up to 4 years in State prison, Probation and/or fines.

Third degree criminal possession of a weapon – Simple possession of a firearm with a prior criminal history, possession of a defaced or stolen weapon – as well as possession of an assault weapon – is a class D felony, which is punishable by a prison sentence of up to seven years.

Second degree criminal possession of a weapon – Illegal possession of a loaded handgun – or five or more firearms – is considered a class C felony, which is punishable by a prison sentence of up to 15 years. It carries a mandatory minimum of three and one half years in prison.

First degree criminal possession of a weapon – Illegal possession of 10 or more firearms – or any explosives with an intent to use it against another person or entity – it is considered a class B felony, which is punishable by a prison sentence of up to 25 years.
