You can be charged with prostitution in New York if you engage in, agree to engage in, or offer to engage in sexual acts with another individual in exchange for money. Prostitution is considered a class B misdemeanor, punishable by a maximum jail sentence of three months and a fine of up to $500. However, if prostitution occurred in a school zone, it is a class A misdemeanor. A class A misdemeanor is punishable by a maximum jail sentence of one year and a fine of up to $1,000.

Loitering for the Purpose of Prostitution involves walking around in a public place a repeatedly beckoning to others for the purpose of engaging in prostitution. Patronizing a prostitute involves the actual act of paying or agreeing to pay someone to engage in sexual conduct for a price. In addition, this offense can involve soliciting or requesting another individual to engage in sexual intercourse for money.

The following are the levels of patronizing a prostitute include:

  • If an offender is over 21 years old and patronizes a person who is under 17 years of age (class A misdemeanor)
    • Maximum jail sentence of one year
    • Fine of up to $1,000
  • If an offender is over 18 years old and patronizes a person under 14 years of age (class E felony)
    • Prison sentence of one and a half to four years
    • Fine of up to $5,000
  • If an offender is over 18 years old and patronizes a person under 11 years of age (class D felony)
    • Prison sentence of two to seven years
    • Fine of up to $5,000

If a person knowingly advances or profits from prostitution or with the intent to advance or profit from prostitution by distributing to 10 or more people in a public place obscene material that depicts nudity, it is considered the class A misdemeanor of promoting prostitution.

The crime of sex trafficking is a class B felony, which is punishable by a prison sentence of up to 25 years.
