DWI Related Child Endangerment

Seek Legal Representation With One of Our Experienced New York DWI Lawyer

Being charged with a DWI can result in severe penalties including fines, surcharges, DMV fees, probation, jail and more. However, being charged with a DWI when a child is in the car is even more serious. In New York, under what is known as Leandra’s law when a person commits a DWI with a child under 16 years of age in the car the motorist can be charged with a Felony.

Leandra’s Law is named after Leandra Rosado who was an 11 year old that was killed in a DWI related crash. Under Leandra’s law even a first time offender can face a Class “E” felony and 4 years in prison if they drive while intoxicated by alcohol or impaired by drugs with a child under 16 in the car.
