The following are the penalties for possession of a weapon in NY:

  • Fourth degree criminal possession of a weapon – Simple possession of a firearm is considered a class A misdemeanor, which is punishable by a jail sentence of up to one year and a maximum fine of $1,000.

  • Third degree criminal possession of a weapon – Simple possession of a firearm with a prior criminal history – as well as possession of an assault weapon – is considered a class D felony, which is punishable by a prison sentence of up to seven years.

  • Second degree criminal possession of a weapon – Illegal possession of a loaded handgun – or five or more firearms – is considered a class C felony, which is punishable by a prison sentence of up to 15 years.

  • First degree criminal possession of a weapon – Illegal possession of 10 or more firearms – or any explosives with an intent to use it against another person or entity – it is considered a class B felony, which is punishable by a prison sentence of up to 25 years.
